GENERAL CONDITIONS OF SALE
1. Acceptance of the general terms and conditions and conclusion of the contract
1.1 The contract entered into between A&M S.r.l. (hereinafter "Arti & Mestieri") and the Customer (i.e. the subject, natural person, who makes the purchase on the Site, not related to his own commercial, entrepreneurial or professional activity) shall be considered concluded with the acceptance, even partial, of the order by Arti & Mestieri. In case of non-acceptance of the order, Arti & Mestieri shall in any case promptly inform the Client.
1.2 By placing an order in the various ways provided, according to the order form present on the Site (hereinafter the "Order"), the Customer declares that he/she has read all the information provided to him/her during the purchase procedure and fully accepts these general conditions (hereinafter the "Conditions").
1.3 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by the italian Legislative Decree 21/2014.
2. Purchase modalities
2.1 The products offered for sale by Arti & Mestieri are only those present on the Arti & Mestieri website at the time the Order is placed, as described in the relevant information sheets.
2.2 In any case, it is understood that the images accompanying the product description sheet are for information purposes only and may not be perfectly representative of its characteristics, but may differ, for example, in colour and size (also due to the browser and monitor used to access the Site and view the images).
2.3 In order to place an Order, the Client shall fill in the relevant form on the Site in all its parts and send it after having carefully examined the Conditions, as well as the characteristics of the product and/or the products he intends to purchase. The Customer shall also request Arti & Mestieri, if he/she so wishes, to issue a tax invoice for the purchase, pursuant to Article 22 of Italian Presidential Decree no. 633/1972.
2.4 The correct receipt of the Order shall be confirmed by Arti & Mestieri by means of an e-mail reply, sent to the e-mail address communicated by the Client. This confirmation message will summarise the purchase conditions, as provided for by the applicable regulations, as well as the data entered in the Order by the Client, so that the latter can verify them and, if necessary, communicate the necessary corrections of incorrect data without delay.
3. Prices and Methods of Payment
3.1 The prices indicated on the site are inclusive of taxes and VAT. Any shipping costs or payment charges are in any case communicated to the Customer in advance via the site or these Conditions.
3.2 The following payment methods are available:
(i) PayPal
For payment, the Customer may use the Paypal circuit in accordance with its specific terms.
(ii) Credit card
In case of purchase of goods with Credit Card payment method, the transaction may take place through the secure server chosen by Arti & Mestieri.
In no case and at no stage of the payment Arti & Mestieri shall be able to know the information related to the Client's credit card, transmitted through a protected connection directly to the site of the bank managing the transaction. No Arti & Mestieri's computer file will keep such data and therefore in no case Arti & Mestieri shall be held responsible for any fraudulent and undue use of credit cards by third parties during the payment.
(iii) Bank transfer
It is also possible to pay by bank transfer Once you have completed your order, we will prepare your order as soon as our bank confirms that the order has been credited.

4. Delivery of products and related costs
4.1 The purchased products shall be delivered to the address indicated by the Client in the Order within three days from the acceptance of the Order by Arti & Mestieri, at the cost specifically indicated on the Site before the Order is sent. Arti & Mestieri reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may vary.
4.2 With regard to deliveries requested to countries outside the European Union, any customs import charges shall be borne by the consignee. The Customer is therefore invited to contact the customs authorities of his country in advance to check the costs and any import limits.
4.3 The delivery times indicated by Arti & Mestieri must be considered purely indicative and a delay with respect to the same, or any delivery made in subsequent split shipments, shall not entitle the Customer to refuse the delivery and to request compensation or indemnity.
4.4 Al momento della consegna dei prodotti, il Cliente è tenuto a controllare:
- che il numero dei colli in consegna corrisponda a quanto indicato nel documento di trasporto.
- che l'imballo risulti integro, non danneggiato, né bagnato o comunque alterato, anche nei materiali di chiusura (nastro adesivo o reggette metalliche).
Any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately detected, with a specific indication on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.
5. Right of Withdrawal
5.1 Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason whatsoever, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.
5.2 In order to exercise the right of withdrawal referred to in Article 5.1 above, the Client must send Arti & Mestieri a communication to that effect, within the terms indicated, to the following email address shop@artiemestieri.it, or use the appropriate form on the Site.
Registered users may access the "RETURNS" section of their user dashboard and manage their return requests.

5.3 In the event of withdrawal, the Customer shall return the products to our warehouses at his or her own expense within 14 (fourteen) days from the date of withdrawal, to the following address A&M S.r.l. - Via Borro del Tasso, 217 - 52028 Terranuova Bracciolini (AR) - Italy
The goods must be returned undamaged, complete with all parts and in their original packaging (envelopes and packages), stored and, if necessary, used for the time strictly necessary to establish and verify their nature and characteristics, according to normal diligence, without any signs of wear and tear or dirt, in compliance with the conditions set out below:
- the right of withdrawal may be applied to the purchased product in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, complements, etc.);
- for withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc.);
- shipping costs (and customs charges, if any) for the return of the goods shall be borne exclusively by the Customer.
- shipment, until the certificate of receipt in the warehouse indicated, is under the full responsibility of the customer;
- in case of damage of the good during the transport, Arti & Mestieri shall inform the Client, in order to allow him to file a timely complaint against the carrier chosen by him and to obtain the relevant refund; the product shall then be put at the Client's disposal, at the same time cancelling the withdrawal request;
- Arti & Mestieri will not answer in any way for damages, theft, loss occurred during or however in dependence of the shipment for the return.
PLEASE NOTE: It is not possible to request an exchange or a refund for a package of products (with explicit letters requested by the Customer, etc.), unless the goods are defective or do not conform to the order placed (art. 5 paragraph 3 letter c of Legislative Decree no. 185 of 22/05/1999).
5.4 Arti & Mestieri shall reimburse the Customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2 of Legislative Decree no. 21/14), within 14 (fourteen) days from the withdrawal, by means of a transfer procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Client shall not bear any cost as a consequence of said refund. Arti & Mestieri may suspend the refund until receipt of the returned product or until the Customer proves to have correctly returned the product, whichever is earlier.
5.5 In any case, the Client shall forfeit the right of withdrawal in cases where Arti & Mestieri ascertains that
- the returned product and/or its accessories, and/or its packaging are not intact
- the product is missing its external packaging and/or its original internal packaging
- the product is missing integral elements of the same and/or accessories (e.g. hands, glass dials, glasses, etc.).
In the event of forfeiture of the right of withdrawal, Arti & Mestieri shall return the purchased product to the sender, charging the sender for the shipping costs and, if already refunded, the price of the product.
6. Warranties
6.1 All products sold by Arti & Mestieri are covered by a 24 (twenty-four) month warranty for conformity defects, pursuant to Title III of Legislative Decree 206/2005. In order to benefit from assistance under warranty, the Customer shall keep the invoice, or rather the payment receipt, together with the transport document.
6.2 The guarantee for conformity defects shall apply provided that the relevant product has been used correctly, in accordance with its intended use and with the provisions of the instructions for use and washing present in and/or with the product.
6.3 In the event that, for any reason, Arti & Mestieri is not able to return to the Client a product under warranty (repaired or replaced), or if the repair or the replacement is, also due to the value of the product, excessively onerous, Arti & Mestieri shall be entitled to proceed to the reasonable reduction of the price paid, or to the restitution of the entire amount paid with termination of the contract.
6.4 In cases where the application of the warranties provides for the return of the product, the same shall be returned by the Client in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

8. Privacy
8.1 The personal data collected by placing the Order will be processed by &M S.r.l. for the sole purpose of satisfying the express requests of the Customer, in compliance with EU Regulation 2016/679 and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Customer.
9. Applicable law
9.1 The contract of sale referred to in these Conditions and its execution shall be governed by Italian Law, with the disapplication of the conflict rules and the United Nations Convention for the International Sale of Goods. The Court of Florence shall be competent for the resolution of the relative disputes.
